2. The case of the prosecution is that the petitioners along with A2
conspired together and murdered the victim, who is the brother of the defacto
complainant and hence the case.
3. The learned counsel for the petitioner would submit that there a re
about 5 accused and the petitioner herein is A1, the wife of the de ceased. He
would further submit that she has been falsely implicated in thi s case and she
has been under incarceration since 26.02.2026 and hence prayed to enlarge the
petitioner on bail.
4. At this juncture, the learned Government Advocate (Criminal side )
appearing for the respondent police would strongly objected the bail appli cation
stating that investigation is at preliminary stage and he would f urther submit
that if the petitioner is enlarged on bail, it would jeopardise the investigation.
5. I have given anxious consideration to the submissions made by the
learned counsel on either side.
6. The contention of the learned Government Advocate cannot be
ignored. Considering the totality of circumstances and upon the fact that the
investigation is at preliminary stage, this Court is not inclined t o enlarge the
petitioner on bail at present.
