ORDER
This Criminal Original Petition has been filed seeking to quash the
proceedings in C.C.No.37 of 2023 on the file of the Judicial Magistrate,
Kangeyam, Tiruppur District.
2. The case of the prosecution is that the second respondent owned
agricultural land comprised in Re-Survey No.883/A5, measuring an extent of
5.26 acres, situated at Naal Road Village, Kangeyam Taluk, Tiruppur District.
It is alleged that when the second respondent attempted to fence his property,
the petitioners obstructed the same due to previous enmity. Further, it is alleged
that on 24.09.2022, at about 1.00 a.m., the petitioners trespassed into the land of
the second respondent and damaged the fencing stones by using hammers. The
petitioners also threatened the second respondent and his wife with dire
consequences. Hence, the complaint.
3. On receipt of the said complaint, the first respondent registered an
FIR in Crime No.471 of 2022 for the offences punishable under Sections 447,

respondent filed a final report and the same has been taken cognizanc e by the

respondent filed a suit in O.S.No.21 of 2022 on the file of the District Munsif

5. At the same time, the petitioners also filed a suit in O.S.N o.205 of
2022 on the file of the District Munsif Court, Kangeyam, seeking injunction
against the second respondent, thereby restraining him from interfering with
their peaceful usage of a pathway marked as A B C D, comprised in Survey
