For Petitioners: Mr,K.Sudhakar For Respondent(s): Mrs.Indhu Bala (R1) Additional Government Pleader ORDER This Writ Petition has been filed seeking a direction to the r espondent to disburse the statutory entitlement namely 30% solatium with interest till the date of payment, in the light of judgment of Hon’ble Supreme Court in the case of Union of India and Another Vs Trasem Singh and others, in Civil Appeal No. 7064 of 2019 at 19/9/2019 by considering petitioners representation dated 29.08.2022 within time framed manner. 2. The learned counsel for the petitioners would submit that the petitioners land was acquired for formation and widening four/six l aning of https://www.mhc.tn.gov.in/judis WP No. 32875 of 2022 __________ Page6 of 9 roads on NH No.68 at Salem District, under the National Highways A ct, 1956, for which compensation was paid to the petitioners. However solatium was not paid to them. 2.1.Further he would submit that the petitioners are entitled for solat ium as per the Judgment of Hon’ble Apex Court in the case of Union of India and Another Vs Trasem Singh and others (Civil Appeal No. 7064 of 2019 date d 19/9/2019). Hence, the petitioners made a representation to the respondents on 29.08.2022, seeking to disburse the statutory entitlement viz., namely 30% solatium with interest till the date of payment. As the same did not evoke any response, the petitioners have come forward with this writ petit ion seeking for the aforesaid relief. 3. In reply, the learned Additional Government Pleader appearing for the respondent would submit that the petitioners’ representation dated 29.08.2022 will be disposed of by the 1st respondent within a period of twelve weeks. 4. Heard both sides. Perused the materials available on record. 5. Considering the facts and circumstances of the case and having rega rd to the submissions made, this Court directs the 1 st respondent to consider the petitioners’ representation dated 29.08.2022 on its own merits and dispose of https://www.mhc.tn.gov.in/judis WP No. 32875 of 2022 __________ Page7 of 9 the same in accordance with law, in the light of Judgment of Hon’ble Supreme Court in Union of India and Another Vs Trasem Singh and others (Civil Appeal No. 7064 of 2019 dated 19/9/2019) within a period of twelve weeks from the date of receipt of copy of this order, . 6. With the above directions, this writ petition is disposed of.
