Side) for R4 R3 - No Appearance M/s.J.Kingsly Solomon for R5 to R8, R10 to R12 Mr.A.Thomas Antony for R13 https://www.mhc.tn.gov.in/judis WP No. 32218 of 2024 __________ Page3 of 6 ORDER This Writ Petition has been filed to direct the respondents 1 a nd 2 to consider the petitioners’ representation dated 26.09.2024. 2.The learned counsel for the petitioner would submit that in this case, the petitioners made a representation dated 26.09.2024 to initiate penal action under section 81A and 82 of the Registration Act 1908 against 3 rd and 5 th to 13 th respondents. Since no order was passed, the present writ petition is filed. 3. In reply, the learned Additional Government Pleader appearing for t he respondents 1 & 2 would submit that the petitioner’s representations w ill be disposed of by the respondents within a period of eight weeks. 4. Heard the learned counsel for the petitioners and the learned c ounsel appearing for the respondents and also perused the materials availabl e on record. 5. In view of the above, this Court directs the respondents 1 and 2 t o consider the petitioner’s representation dated 26.09.2024 on its own merits and pass appropriate orders on the same, in accordance with law, within a period of eight weeks from the date of receipt of copy of this order. Once if the respondents come to conclusion that the 3 rd respondent is involved in the https://www.mhc.tn.gov.in/judis WP No. 32218 of 2024 __________ Page4 of 6 commission of any criminal offences colluding with respondents 5 to 13, the 1st and 2nd respondents shall lodge a complaint before the 4 th respondent. In such case, the 4th respondent shall take action for commission of criminal offences in terms of section 81-A and 82 of the Registration Act, 1908 within a period of twelve weeks from the date of such complaint. 6. With the above directions, this writ petition is disposed of.
