ORDER
(Made by SUNDER MOHAN, J.)
The wife of the detenu has challenged the detention order dated
28.08.2025 branding him as a ‘drug offender’.
2.We have heard the learned counsel for the petitioner and the
learned Additional Public Prosecutor.
3.We find from the grounds of detention that the detenu had not
moved any bail application in the ground case. The detaining authority
had observed that the relatives are taking steps to take him out on bail and
had relied upon an order passed in Crl.M.P.No.5272 of 2023 in which the
facts are said to be similar to the facts in the instant ca se. However, on
perusal of the of the order passed in Crl.M.P.No.5272 of 2023, we find
that the order was passed under Section 167(2) of the Cr.P.C. Act and not
on merits. Therefore, the reliance upon the said order by the deta ining
authority is misconceived and hence the detention order is liable to be set
aside.
